1. Acceptance of Terms

Welcome to Montessori Christmas Tree. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "User," or "you") and Montessori Christmas Tree ("Company," "we," "us," or "our"), governing your access to and use of our website located at https://montessorichristmastree.com (the "Site") and the purchase of our products.

By accessing the Site, registering an account, or completing a transaction, you expressly agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not accept these Terms in full, you must discontinue use of the Site immediately.

2. Eligibility and Age Requirements

The Site and its commercial services are intended exclusively for individuals who are at least 18 years of age or the age of legal majority in their jurisdiction of residence. We strive to present product images, descriptions, dimensions, and specifications (including the Montessori Christmas Tree's 28.0" x 40.2" felt fabric build and 25 ornaments) as accurately as possible. However, slight variations in monitor color rendering may occur. We do not warrant that product descriptions or other site content are entirely error-free, complete, or current. We reserve the right to correct any typographical errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice (including after you have submitted your order).

5. Order Acceptance, Modifications, and Cancellations

Receipt of an electronic order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept, decline, or limit order quantities for any legitimate reason, including credit validation failures, suspect fraudulent activity, or unresolvable inventory discrepancies. If an order is canceled after your payment has been processed, we will issue a full refund to your original payment method.

All prices posted on this Site are displayed in United States Dollars (USD) unless otherwise explicitly stated. Payment must be received by us prior to our acceptance of an order. We accept major credit cards and authorized third-party payment gateways. You represent and warrant that the payment details provided are valid, accurate, and authorized for use.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, MONTESSORI GENERATION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ADULT SUPERVISION IS REQUIRED AT ALL TIMES FOR INFANTS AND TODDLERS INTERACTING WITH FELT ACCESSORIES.

IN NO EVENT SHALL MONTESSORI GENERATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SITE OR THE PERFORMANCE OR PURCHASE OF PRODUCTS, REGARDLESS OF THE THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR MAXIMUM TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE ORDER GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless Montessori Christmas Tree, its affiliates, contractors, licensors, and their respective directors, officers, and employees from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or legal fees arising out of or relating to your violation of these Terms or your misuse of the Site or purchased products.

12. Governing Law and Dispute Resolution

These Terms and any separate agreements whereby we provide you products shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Site shall be resolved through binding individual arbitration administered under the commercial rules of the American Arbitration Association, waiving any right to participate in a class-action lawsuit or class-wide arbitration.

13. Severability

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of any remaining provisions.
